These Terms & Conditions ("Terms") govern the terms on which users ("You", "Your", "User") access and/or register on the website www.myindia.fit (the "Platform"), operated and managed by Shoonyam Earth Pvt Ltd ("Shoonyam Earth Pvt Ltd", "We", "Us", "Our"). The Platform is used for the marketing and sale of VITO Energy Pouches and other permitted wellness or functional products that may be introduced from time to time.
By accessing the Platform, registering on it, placing an order, or otherwise using our services, you accept these Terms and Our Privacy Policy and agree to be legally bound by them. Please read these Terms and the Privacy Policy carefully before using the Platform.

We reserve the right to modify or amend these Terms at any time, at Our sole discretion, without prior notice. It is Your responsibility to review these Terms periodically. Your continued use of the Platform after any changes constitutes Your acceptance of the revised Terms.

1. Eligibility to Use Services

You must be at least 18 (eighteen) years of age and competent to enter into a binding contract under the Indian Contract Act, 1872, to register on or place an order through the Platform. By using the Platform, you represent and warrant that You meet this eligibility requirement. VITO Energy Pouches are a caffeine-based product intended solely for adult use.

2. User Details / Account, Password and Security

If You create an account on the Platform, you are responsible for maintaining the confidentiality of Your login credentials and for all activities that occur under Your account. You agree to notify Us immediately of any unauthorised use of Your account. We are not liable for any loss or damage arising from Your failure to protect Your account information.

3. Payment Services

All payments made on the Platform are processed securely through authorised third-party payment service providers and payment gateways. We do not store complete card or payment instrument details on Our servers. By making a payment, You authorise Us and Our payment partners to process the transaction using the payment method selected by You.

4. Pricing and Modifications

All prices listed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. We reserve the right to modify prices, discontinue Products, or update Product information at any time without prior notice. In case of a genuine pricing error, We reserve the right to cancel any order placed at the incorrect price and issue a full refund.

5. Order Confirmation and Shipping of Products

An order is confirmed only once You receive an order confirmation email/SMS from Us. We reserve the right to refuse or cancel any order at Our discretion, including in cases of suspected fraud, unauthorised reseller activity, or unavailability of stock. 6. Cancellation, Replacement and Refund

Requests for cancellation, replacement, or refund are handled in accordance with Our Refund Policy, which forms part of these Terms by reference.

7. Use of Platform

You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of or restrict or inhibit the use and enjoyment of the Platform by, any third party. You shall not:

• Use the Platform to transmit any unlawful, defamatory, obscene, or objectionable material;
• Attempt to gain unauthorised access to any portion of the Platform, other accounts, or computer systems connected to the Platform;
• Use any automated means (bots, scrapers, crawlers) to access the Platform without Our prior written consent;
• Resell or redistribute Products purchased from the Platform without Our prior written authorisation.

Product images are for representation purposes. Packaging, colour, or presentation may vary slightly without affecting the nature or specifications of the Product.

8. Intellectual Property Rights

All intellectual property displayed on the Platform, including trademarks, logos, product images and brand names, is owned by Shoonyam Earth Pvt Ltd or the respective rights holders and is used with appropriate authorization.

9. Disclaimer of Warranties & Liability

The Platform and Products are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.

10. Indemnification and Limitation of Liability

You agree to indemnify and hold harmless Shoonyam Earth Pvt Ltd, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of Your breach of these Terms or Your misuse of the Platform or Products. To the maximum extent permitted by applicable law, Our aggregate liability arising from a particular order shall not exceed the amount paid by You for that order, except where liability cannot lawfully be excluded or limited

11. User Comments and Feedback

Any reviews, comments, or feedback You submit on the Platform must not be false, misleading, unlawful, or infringe any third-party rights. By submitting such content, you grant Us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display it for marketing and other business purposes. We reserve the right to remove any content We deem inappropriate.

Information collected from You is subject to Our Privacy Policy, which is incorporated into these Terms by reference.

13. Product Information

Information relating to VITO Energy Pouches on the Platform is provided for general product information only and should not be considered medical advice. VITO Energy Pouches contain caffeine and are intended for adult consumers. They are not intended to diagnose, treat, cure, or prevent any disease. Individuals who are pregnant or breastfeeding, sensitive to caffeine, taking medication, or living with a medical condition should consult a qualified healthcare professional before use.

14. Violation of These Terms

Any violation of these Terms may be treated as an unlawful and unfair business practice and may cause Us irreparable harm, for which monetary damages may be inadequate. We reserve the right to seek any injunctive, equitable, or other legal relief available to Us, in addition to recovering reasonable legal costs incurred because of Your violation.

15. Suspension and Termination

We reserve the right to suspend or terminate Your access to the Platform, without notice, if We reasonably believe You have violated these Terms, engaged in fraudulent activity, or misused the Platform in any manner.

16. IP Infringement

If You believe any content on the Platform infringes Your intellectual property rights, please notify Us in writing at support@myindia.fit, along with details establishing Your ownership of the relevant intellectual property. False claims may result in termination of Your access to the Platform.

17. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 (as amended), conducted by a sole arbitrator mutually appointed by You and Us. The seat and venue of arbitration shall be Bangalore, India, and the arbitration shall be conducted in English.

If You come across any objectionable content or violation of these Terms on the Platform, please report it to support@myindia.fit

19. Communications

By using the Platform, you consent to receive transactional and promotional communications from Us via SMS, WhatsApp, and email. You may opt out of promotional communications at any time by following the unsubscribe instructions in any such communication, or by writing to support@myindia.fit

20. Grievance Officer

For grievances relating to these Terms, orders, payments, or use of the Platform, You may contact Our Grievance Officer using the contact details provided on Our Legal Entity page. We will endeavour to acknowledge and address grievances in accordance with applicable law.

21. General Provisions

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms, together with the Privacy Policy, Shipping Policy, and Refund Policy, constitute the entire agreement between You and Us regarding Your use of the Platform.
